NEW DELHI: Delhi cabinet on Friday approved creation of 22 new commercial courts and 18 permanent fast track courts in the capital. The commercial courts will enable
quicker disposal of disputes and in the long run, create a business-friendly environment and improve the city’s ease-of-doing-business rank.
Law minister Kailash Gahlot stated that the development will reduce pendency of cases and ensure speedy disposal of cases and will bring respite to litigants.
Nearly 89,000 civil cases are pending with 59 subordinate courts in the city. These are apart from the 15,000-odd commercial cases. Courts handling civil matters, including commercial cases, are already saddled with a huge number of cases.
The cabinet took the decision after considering a proposal of the law department for creation of 22 posts of Delhi higher judicial services along with ancillary staff which make a total of 212 posts. It also approved the law department’s proposal for the conversion of 90% of temporary post sanctioned for fast track courts into permanent post which includes 18 posts of additional district judge and 86 posts of ancillary staff which includes senior judicial assistants, senior personal assistants and personal assistants, among other staff.
Earlier this year, the Delhi high court had asked the city government to create 22 posts of higher judicial services at the district judge level for establishing commercial courts and 18 fast-track courts. Following the recommendation of the administrative reforms department, the finance the department gave its approval to the proposal, but had stated that the posts of 48 peons be outsourced.
The courts will be established in different districts to give access to citizens from across the city. Commercial courts have been functional in Delhi HC for some time to ensure speedy disposal of commercial disputes. The commercial benches were started in Delhi and Bombay high courts because these two cities have maximum commercial activity and, as a resultant, a large number of disputes. The country’s ease-of-doing-business rank is largely determined by the performance of Delhi and Mumbai.
