Nagpur: The Nagpur bench of Bombay high court has dismissed a criminal writ petition seeking a stay on the investigation against
doctor couple Yogesh and Pranali Shende.
A division bench comprising justices Pradeep Deshmukh and Pushpa Ganwediwala held that there can’t be interference by the courts in case of investigation.
“If a person has a grievance that his FIR has not been registered by police or after being registered, proper investigation is not being done, then the remedy of aggrieved person is not to go to high court under Article 226 of the Constitution of India, but to approach the magistrate concerned under Section 156(3) of the CrPC,” the judges said.
While disposing of the petition by the doctor couple, the HC directed police to continue investigation and to issue 48 hours’ notice to the petitioners upon registration of the offence. The plea was filed by the medicos praying for a stay on investigations started by police on a complaint by A Armarkar, who accused them of allegedly cheating him in a land deal.
After the doctors moved HC, the complainant also filed an intervention through counsel Amit Khare opposing their contentions.
