Mediation an important tool to resolve disputes

In order to promote mediation an alternate dispute redressal mechanism, the Madhya Pradesh State Legal Services Authority (MPSLSA) hold a refresher programme for the mediators. MP High Court Justice Rajeev Kumar Dubey inaugurated the programme.
The mediation is a voluntary process of dispute resolution where a neutral third party (the mediator) with the use of effective and specialized communication and negotiation techniques aids the parties having dispute over some issue in arriving at an amicable settlement.

The legal experts addressed the mediators about the more techniques and ways to handle the dispute in the refresher programme.
The mediation is therefore a process aimed at finding a middle path amidst the dispute between the parties so that a mutually acceptable solution to worked out. The mediation should be used for resolving complex disputes and is in fact a successful technique to resolve the disputes.

The mediation is facilitated negotiation conducted with the assistance of a third party neutral possessing specialized skills, requisite training and sufficient experience necessary to assist the disputant parties in reaching a negotiated settlement. The process is to reduce bitterness and posturing, enable the parties to realize and understand their priorities and interests and steer them towards a self-determined and mutually acceptable resolution.

The mediator induces and facilitates the parties to enter into a positive dialogue, attempts to break the impasse and enables them to visualize their own solutions in a pragmatic manner. The idea of mediation is to assist people to communicate in a rational and problem solving manner, clarify issues and to help negotiations by bringing realism and objectivity to a dispute.
The mediation is therefore in a sense empowering the parties to think for themselves and choosing what is right for them so that they own the responsibility of arriving at their own decisions.
