Pune police: 10pm deadline for indoor music if it flouts noise norms

PUNE: Bars and lounges will have to stop outdoor music by 10pm and the same deadline applies to indoor entertainment hubs, if the noise creates a public nuisance.

Setting all doubts to rest about whether the 10pm deadline is applicable only to outdoor music or indoor too, Pune’s commissioner of police K Venkatesham said if indoor music played by lounges and bars created a public nuisance and flouted noise norms, police would take action.
He said citizens facing problems because of loud music in their areas can message on the official WhatsApp number of the Pune police and the authorities would take action against the bar or lounge concerned.
Bars had earlier said the Supreme Court law on stopping music at 10pm only applied to outdoor music, but the police were shutting off indoor music early, too.
A 2005 Supreme Court order had banned loud music in open places after 10 in the night. Environmentalist Sumaira Abdulali, the founder of Awaaz Foundation, said, “The SC order of 2005 was further clarified by a judgment of the Bombay High Court in 2016. The ambient noise levels in a public space cannot be exceeded even if the music is played indoors and if it emanates outdoor beyond the permissible limit.”
Venkatesham said, “We are strictly implementing the rule wherever music played by bars becomes a public nuisance, whether it is indoor music or outdoor. We have received 4,000-plus calls at the control room with regard to noise pollution due to loud music across the city till date this year. Hence, our only intention is to follow the SC rule in letter and spirit. Wherever public nuisance is caused because of sound crossing the noise limits prescribed by the apex court, whether it is originating indoor or outdoor, police are bound to take action.”

He said bars and lounges should also respect the Supreme Court rule and see to it that the music they play did not flout it. “We request the bars to respect the laws of land. With regard to this, citizens can help the police take suitable action against erring lounges and bars by dialling 100 or informing on the WhatsApp number of the police control room 8975283100. The police will then address the grievance,” he said.
Bar and lounge representatives had also alleged that the police were enforcing the norm on bars in Koregaon Park only. Venkatesham said, “The stringent checks are being conducted impartially across the city,” he added.
