Pandurang Warora, the NCP MLA from Shahapur constituency, Tuesday resigned as member of the Maharashtra Legislative Assembly.
Warora was accompanied by Shiv Sena leader and state PWD minister Eknath Shinde when he went to Assembly Speaker Haribhau Bagade to hand over his resignation letter, sources said.
Earlier, the Sharad Pawar-led party had 41 MLAs in the state Assembly.
With Warora's resignation and the death of NCP legislator from Malshiras seat, Hanumant Dolas, in April this year, the party's strength in the 288-member Assembly has come down to 39.
