S. Nalini, one of the seven life convicts in the former Prime Minister Rajiv Gandhi assassination case, will be produced before the Madras High Court on Friday for arguing in person her plea seeking ordinary leave for six months to make arrangements for the marriage of her daughter residing in London.
She will be produced before a Division Bench of Justices M.M. Sundresh and M. Nirmal Kumar who had on June 25 directed the Superintendent of Vellore central prison to produce her in the court after rejecting all kinds of security apprehensions raised by the prison officials in ensuring her physical presence.
Though they suggested that the hearing could be conducted through video conferencing, the judges insisted on her consent for following such a procedure.
However, when told by the State that she rejected the suggestion, they directed the prison officials to produce her in court since every litigant had a right to argue in person.
The Division Bench had been hearing a slew of habeas corpus petitions filed in the High Court seeking parole, ever since it began handling the portfolio last month.
It had recently allowed two such petitions and granted 15 days of ordinary leave to life convicts Y. Sirajudeen and K. Amanullah for admitting their children in schools.
Similarly, while disposing another habeas corpus petition filed by the wife of another convict, K. Babu, seeking his release to celebrate their child’s birthday, the judges granted parole to him too for 15 days not for celebrating the birthday but for attending to the needs of his ailing mother.
The court also granted two weeks of ordinary leave to Y.V. Nagaraj, suffering 10 years of imprisonment in a case booked under the Narcotic Drugs and Psychotropic Substances Act of 1985, for nursing in wife suffering from some illness.
