The minister said that as per Section 59 of the RERA, 2016, a promoter or builder would be liable to be imprisoned for three years or pay a fine of 10% of the project cost if he was not registered under RERA and violated the rules and guidelines under the Act. In some cases, both imprisonment and the fine would be imposed, he added.
He further said that his ministry does not maintain data of housing projects. The real estate regulatory authority of the concerned state or Union territory is required to publish and maintain a website of records of relevant details of all real estate projects under its ambit.
The minister said that a promoter shall get a completion certificate within a period of three months for all projects that were under way on the date of commencement of RERA and for which the certificate had not been issued. The buyers may approach the relevant forum based on the facts and circumstances as per applicable laws, even if the project was not registered under RERA, he clarified.
