ALWAR/JAIPUR: The
Alwar police have claimed that
dairy farmer Pehlu Khan was guilty of transporting cows in violation of the Rajasthan Bovine Animal (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Act, 1995.
Khan was, however, not chargesheeted for the crime on account of his death. The chargesheet was presented in court on May 24, more than two years after Khan’s lynching by a mob of cow vigilantes.
Khan, along with his two sons and few others, were transporting cows from Jaipur to their native place in Haryana’s Nuh district when they were intercepted and thrashed by cow vigilantes near Behror in
Alwar district on April 1, 2017. The cow vigilantes accused these men of smuggling cows for slaughter. Khan succumbed to his injuries during treatment at a private hospital in Behror on April 3, 2017. Khan’s lynching had kicked up a storm against the then Vasundhara Raje government, with Congress spearheading the attack against the ruling BJP in the state assembly and on the streets.
The Behror police station had registered seven FIRs in the matter, which included one for murder of Khan and six for illegal transport of bovines (six vehicles were used in the alleged crime). The police had already filed chargesheets in all cases except the seventh one (FIR No: 253/17). Investigation in the last case had been completed on December 30, 2018, but the chargesheet could be presented in court only on May 24, 2019.
‘None of the accused had permission to transport cattle’ "Pehlu Khan’s name had been dropped from the chargesheet on account of his death. The chargesheet filed on May 24 before the court was against Khan’s two sons Irshad (25) and Arif (22) and a third person Khan Mohammad (55),” Alwar SP Paris Deshmukh told TOI on Saturday.
Deshmukh said none of the accused had permission under the Act of 1995 to transport cattle out of the state.
Khan had bought cows from a cattle fair in Jaipur and had receipts for the same, as per claims by his sons. The authorities, however, said Khan ought to have obtained the district administration’s permission to take the bovines out of state as per the Rajasthan Bovine Animal Act, 1995.
Deshmukh said that it would not be right to call Khan a smuggler yet. “As per the RBA Act, prior transit permission is required to transport cows out of Rajasthan’s borders. We did not find any such permission with Khan or any other accused; the administration had not issued any such permission,” the SP said.
The Congress had earlier chided the then BJP home minister Gulab Chand Kataria in Vidhan Sabha when he had claimed that Khan was a cow smuggler. The police had claimed in the FIR two years ago that Khan did not have the permission under the RBA Act to take cows to another state.
