AHMEDABAD: A consumer court has ordered e-commerce giant
Amazon to pay compensation to a
Valsad girl for its failure to deliver parcel of goods ordered to her
doorstep. The delivery boy representing the company refused home-delivery asking her to come to the gate of the township instead.
The Valsad District Consumer Dispute Redressal Forum has asked Amazon India Ltd to pay Rs 3,000 to a student Neha Gadre, according to an order signed earlier this month.
Neha had ordered three books for her mother, who was preparing to appear in National Eligibility Test exam. The court said the amount is to compensate the mental and physical harassment caused to the customer due to failure of home delivery of the books ordered.
Gadre had placed a 'cash on delivery' order for three books on May 13, 2018. As intimated earlier by Amazon, the delivery boy called her in the afternoon of May 16 and told her to collect her parcel from the gate of the township. She insisted on home delivery, but the courier boy refused arguing that home delivery was not his job.

Gadre communicated with Amazon officials immediately who apologized for the failure and requested her to place a fresh order. Gadre was adamant that the company should fulfil her earlier order only. After communicating with the company officials, Gadre sued Amazon for Rs 25,000 and demanded Rs 5,000 for compensation for mental harassment. Amazon defended its case by claiming that Gadre’s order was undeliverable. Amazon also claimed that it is only an online market place and a facilitator. Home delivery was not its responsibility, but the company which supplied the books was actually responsible for the delivery.
The company claimed that it was not bound by any agreement, but the contract was between the customer and the company which supplied the books. Lastly, Amazon submitted that it was Gadre who had returned the order. The court did not accept Amazon’s arguments and held it responsible for home delivery of the parcel.
