Old pension scheme for new teachers?

PATNA: Sounds incredible, but more than 4,000 assistant professors serving in different colleges and universities of the state are not sure whether their services would be governed by the old pension scheme or the new one. Although the new scheme came into effect from September 2005, neither the university Acts have so far been amended nor the existing service statutes have been revised by the competent authority.
“The provident fund (PF) contributions of these teachers are being deducted by the universities every month, but that amount is not being credited to their respective accounts. Needless to say, these teachers will have to suffer a loss of interest on their PF contributions,” Patna University Teachers’ Association president Randhir Kumar Singh told this reporter.
In his judgment delivered on May 9, 2018 in CWJC No. 3155 of 2017 (5), Justice Anil Kumar Upadhyay of Patna high court had ordered that the employees, who had been appointed after September 1, 2005, would be governed by the old pension scheme and not the new contributory pension scheme. The order further stated that corresponding changes and amendments would have to be brought about by the university in conformity with the Bihar Pension Rules if it wanted to implement the new pension scheme, the judgment said.
Even as Patna University notified the new pension scheme in 2012, at least seven years after its notification by the Union government, the new statutes governing its application in the universities are yet to come. PU had sent the draft statutes relating to the new pension scheme to the state education department nearly five years back, but the same could not be finalized and approved by the competent authority till date.

PU registrar Manoj Kumar Mishra said the PF contributions deducted from the salaries of teachers were lying in the bank, earning 3.5% interest. The same is not being sent to the proper PF account as the government has not released its contribution so far.
The chancellor’s secretariat has recently constituted a three-member committee, headed by PU vice-chancellor Rash Bihari Prasad Singh, to revise the service statutes of university employees, but it is not known whether this committee is empowered to frame the statutes relating to the new pension scheme.
