A division bench comprising Acting Chief Justice Raghvendra Singh Chauhan and Justice Shameem Akther said it would hear the petition against CLP merger with TRS on Tuesday. The writ petition was filed by Congress MLA Mallu Bhatti Vikramarka and Nalgonda MP N. Uttam Kumar Reddy.
Along with this petition, the bench would hear another petition filed earlier questioning the validity of the merger of the Congress Council Legislature Party with that of TRS. This petition was filed a few weeks ago.
In the present plea, the petitioners said the merger of a legislature party was the statutory duty of the Election Commission of India and not a legislative function of the Assembly Speaker. They sought an order to declare that the Speaker had exceeded the constitutional powers entrusted to him by notifying the merger.
They also requested the bench to instruct the Speaker to expeditiously decide upon the petitions filed by the Telangana unit of the Congress to disqualify its MLAs who joined the Congress. Mr. Vikramarka and Mr. Reddy asked the bench to suspend the notification issued by the Speaker in this regard.
