Mohali woman gets 6-month imprisonment for cheque bounce

CHANDIGARH: A district court here has sentenced a Mohali resident to six-month rigorous imprisonment in two cheque-bounce cases. The court also ordered the convict to pay double the amount of the cheques to the complainant within two months.
The court said, "Punishment should be a deterrent which should serve as a lesson for others as well. In this case, justice would best be served if the convict is directed to pay compensation of double the amount of the cheques to the complainant."
Advocate T S Sudan, counsel for complainant Jagjit Singh, argued that Sarabjit Kaur of Phase XI, Mohali, took a friendly loan amounting to Rs 3.80 lakh from time to time from the complainant through cheque as well as cash, the accused claimed she required for personal needs and to support her husband's gold business. In September 2016, the complainant went to the accused and asked her to return the money. She promised to pay Rs 3.80 lakh in instalments. Ultimately, in order to discharge her legal liability, the accused issued a cheque amounting to Rs 2 lakh on April 2, 2018 and another cheque amounting to Rs 1.80 lakh on April 10, 2018, in favour of the complainant.

On presenting the cheques for encashment, the accused's banker dishonoured the same giving the remarks "account closed" vide. Thereafter, a legal notice was served to the accused, but she did not make the payment.
The court convicted Kaur in both the cases and directed her to undergo rigorous imprisonment for a period of six months each.
