Ramesh Bidhuri freed in activist assault case

NEW DELHI: BJP MP Ramesh Bidhuri and his four associates were acquitted by a Delhi court of voluntarily causing hurt to a social activist 15 years ago after witnesses gave contradictory statements.

"Complainant is unable to prove his case beyond reasonable doubts..," said additional chief metropolitan magistrate Samar Vishal. Besides Bidhuri, the other accused were Azad Singh, Mahesh Pandit, Suresh and Prakash. They had been prosecuted under Section 323 (voluntarily causing hurt), read with Section 34 (common intention) of the IPC. The complainant, Ram Shankar, had alleged that Bidhuri verbally abused him at an event, and later he and his associates physically assaulted him.
Bidhuri had claimed innocence, saying he was not present at the place of the incident. Three witnesses testified in court against Bidhuri. Calling two of the witnesses as "interested", the court said since it was case of assault, the absence of an MLC (medico-legal case) to prove this fact, was an important factor.
