The first incident was during the 2018-2019 Christmas holidays after she had been 'badly behaving' at the supermarket.

The second incident happened after he found out she had outed his cruel form of punishment to the school counsellor.

The court heard he grabbed her by the ear, asked her why she was 'snitching' on him and then tasered her leg.

The brother's lawyer, Maurice Navarette, said the taser attacks were viewed as a form of discipline rather than punishment.

'He found the taser in the park, thought it was a phone, found it funny, took it home and that is where he kept it,' Mr Navarette told the court, according to the publication.

'[He acknowledges] he shouldn't have used it on his sister.'

Mr Navarette also argued that his client had already served four months in prison since his arrest, had no history of violence and had witnessed domestic violence as a child himself.

Magistrate David Degnan rejected the claims that the acts were disciplinary action and called the tasering of a child 'gratuitous violence'.

He said during sentencing he was not able to figure out why victims of domestic violence become offenders themselves and that as the girl's brother he should have provided her protection.

The man please guilty to possession of a prohibited weapon and assault occasioning actual bodily harm.

He was sentenced to 16 months in jail with a non-parole period of nine months.

The girl's mother is also facing charges in relation to the taser attacks and has pleaded not guilty.
