A New Zealand man who was mistakenly deported from Australia has been left angered as he was never told of the error.

Bruce Moana, 31, was appealing his cancelled visa when he was deported to New Zealand in August last year.

Chief Justice James Allsop ruled that the deportation should not have happened and ordered Immigration Minister David Coleman and his department search for Mr Moana.

However, Mr Moana was unaware that circumstances had changed and said he was never told his deportation was a mistake.

'It's all bull***,' he told Newshub on Thursday.

'That's time I missed out on with my family.'

Mr Moana, who has lived in Australia since he was 13, had his visa cancelled in 2016 as he was deemed a risk to the community after serving time for assault, stealing and burglary.

He had first attempted to appeal the decision but lost his case because he had lodged the wrong forms as he did not have any legal assistance.

He originally challenged the decision by claiming he had not received the required notification of his visa cancellation.

He then launched another appeal, arguing he was denied procedural fairness.

The appeal was three weeks away from being heard in the Federal Court when Mr Moana was deported, The Sydney Morning Herald reported.

In a written decision, Chief Justice Allsop said he was not satisfied Mr Moana had been given reasonable opportunity to approach the court for an appeal.

'The (minister) must take responsibility for ensuring that no one is removed from this country while there are proceedings pending in this court challenging the validity of that removal.

'I expect the department to make appropriate and proper efforts to find Mr Moana and inform him of his ability to seek to maintain his application, notwithstanding his presence in New Zealand.'
