HC rejects plea seeking stay on movie release

The Delhi High Court on Monday rejected a petition seeking stay on the release of Salman Khan-starrer Bharat, which is slated to hit the theatres on June 5, saying the petition was premature.

A Vacation Bench of Justice J.R. Midha and Justice Chander Shekhar was displeased that the petitioner circulated the petition in the media before it was listed in court. At the outset, the High Court watched the trailer of the movie on the petitioner Vikas Tyagi smartphone. It then asked Mr. Tyagi what was objectionable in the trailer.

“There are so many persons named ‘Bharat’, so if they are doing anything wrong, should we put all of them behind bars? Should we ban individuals from having the name ‘Bharat’?” the Bench said. Mr. Tyagi said his objection was that the character ‘Bharat’, which was played by Salman, was a womaniser. The plea had said that the Emblems and Names (Prevention of Improper Use) Act prohibited the use of the name ‘Bharat’ for any trade, business, profession, or in a title of any patent and in any trademark.

“The email sent to media houses showed that the intention of the petitioner was to draw mileage from it. This court is of the view that the petition is premature as the petitioner has not yet seen the full movie,” the High Court said while dismissing the plea.
