The State government on Wednesday informed the Kerala High Court that the bank authorities were not responsible for the suicide of a mother and her daughter at Neyattinkara as the investigation had not revealed anything to support the allegation that the eviction process initiated by the bank for recovery of the unpaid loan was the cause of the suicide.
The submission was made by senior government pleader Suman Chakravarthy when a writ petition filed by Chandran Rudran, husband of the deceased woman for quashing the recovery proceedings initiated by the Canara Bank for non-payment of home loan came up for hearing
The government pleader also submitted that the role of the bank or any untoward activities from the bank’s side whatsoever was not mentioned in the suicide note left by the deceased wife of the petitioner. In fact, the suicide note blamed her husband and his relatives for the suicide, citing dowry issues and other family problems. The police had later arrested the petitioner and his relatives in a case registered against them under Sections 306 (abatement of suicide) and 498A (subjecting a woman to cruelty by husband or relative of husband) of the IPC and they were now in judicial custody. He also informed the court that the scene of crime was no more essential in the investigation of the crime as detailed mazhar was prepared and inspection by scientific experts was over.
The High Court closed the petition filed by the husband of the deceased woman and gave the bank liberty to proceed with the recovery proceedings in accordance with the law in view of the submissions by the pleader.
