THANE: The district court sentenced a 27-year-old Manpada resident to two years of rigorous imprisonment for molesting a minor girl.
Special POCSO Judge SA Sinha convicted Manpada resident, Vilas Kakade for the repeated mental harrassment and physical torture of a 15-year-old schoolgirl.
Prosecutor Vijay Mundhe said Kakade would stalk the girl on her way to school and upon resistance he would use filty language against her.
The girls parents approached him and tried to reason with him but in vain. In fact, Kakade threatened to kill her family members if she rejected his proposal.
On November 02, 2017 at around 9:30am while the victim was returning from school the accused caught her hand and molested her. He also flashed a knife and told her that he would commit suicide and blame her for the same and slit his wrist.
Again on January 30, 2018 he repeated the same act. Kakade pulled out a knife and threatened her while she was returning from school following which the girl's parents filed a police complaint after which the accused was arrested. Kakade was booked under
Indian Penal Code Section 354 (assault or criminal force on woman with an intent to outrage her modesty) and relevant sections of the Protection of Children from Sexual Offences (POCSO) Act.
The defence counsel contended the prosecution version but the judge after hearing both the sides pointed out, “..the girl's testimony is important and fully corroborated by her mother, whom she informed about the offence. It is but natural that every daughter has to immediately state the incidence which was happened with her to her mother. She is a nearer friend of the daughter. Therefore, she immediately disclosed the matter to her mother and her mother has taken the proper step and tried to persuade the accused and gave understanding to him, but, accused is not ready to listen to anybody and threatening to all including the parents of victim girl.”
Another prosecution witness, who used to accompany the girl, supported and corroborated the victim's testimony, the judge observed while convicting the accused.
