KAT directive on teacher’s transfer

The Kerala Administrative Tribunal has asked the Higher Education Secretary to pass appropriate orders in connection with the transfer of a differently abled lecturer at Central Polytechnic College, Vattiyurkavu.

The order comes on a petition by Baiju G.S., a lecturer with 90% visual impairment.

The tribunal, in its order, noted that the applicant was posted at the Central Polytechnic on compassionate grounds.

Of the eight posts of lecturers there, three posts were shifted and accordingly three lecturers, including the complainant, were transferred.

However, this was done without considering the provisions of the Rights of Persons with Disabilities Act, 2016, that those with disabilities should be granted convenient posting. The government had earlier issued orders that persons with more than 60% disability should be retained at their respective stations, and the applicant is entitled to benefit from the order. Moreover, the State Commissioner for Persons with Disabilities had also directed the Higher Education Secretary to retain the applicant at the present station.
