‘L-G is only informed about Cabinet decisions’

The Madras High Court judgment upholding powers of the elected government was based on its “interpretation” of the Union Territories Act and Business Rules, Chief Minister V. Narayanasamy has said.

The Chief Minister told The Hindu that the court interpreted various provisions in the Union Territories Act and Business Rules to conclude that only an “elected government had the power to administer and take decisions.”

The Chief Minister was giving his reaction to Lt. Governor Kiran Bedi's statement on the issue.

“Where is the need to amend rules when the judge has interpreted the rules to state that power lies with the elected government. Cabinet decisions are communicated to her for information and not for approval,” he said. Whether it was service matter or financial powers, the court had made it clear that the Cabinet decision would be final, he said. Those in government positions should implement the court order. Otherwise, it would amount to contempt of court, he said.
