Against award of ₹9.18 lakh as compensation to deceased passenger

MADURAI

The Madurai Bench of the Madras High Court has dismissed the appeal preferred by the TNSTC against the order of a Motor Accident Claims Tribunal that awarded a sum of ₹9.18 lakh as compensation to the family of a deceased passenger.

It is said that in 2011 the deceased, Nagarathinam, was travelling along with his relative on a TNSTC bus from Madurai to Karur. Due to rash and negligent act of the driver, the deceased, who was sitting near the rear end of the bus, was thrown out. Nagarathinam died on the spot due to the impact.

The TNSTC, in its appeal against the order of the Motor Accident Claims Tribunal, denied the act of negligence on the part of the driver. It claimed that the deceased was in an inebriated state at the time of the incident. As a result, he lost his balance, fell from the bus and died on the spot, the TNSTC said.

Justice S. Ramathilagam took into account that the deceased was survived by his wife, two minor children and aged parents, said that the compensation of ₹9.18 lakh awarded by the tribunal was reasonable and dismissed the appeal preferred by the TNSTC.
