Firm failed to deliver services promised against amount charged

A District Consumer Disputes Redressal Forum here has directed a city based travel agency to compensate a complainant by paying over ₹62,000 following allegations of false promises made by the company.

Noting that the complainant was asked to pay over ₹47,000 by offering “attractive holiday packages,” the Bench observed that the company had failed to deliver the services promised against the amount charged.

Incorrect receipts

Additionally, the consumer forum observed that the company, Panoramic Holiday Ltd., was deficient in services as it had provided incorrect receipts of the amount charged.

“We are of the opinion that receiving an amount of ₹47,310 and giving a receipt of ₹26,250 in itself is resorting to unfair trade practice. Further the complainant not having availed a single facility [from the company] is entitled to refund of his full amount,” the consumer panel observed.

The directions came when a complainant moved the consumer panel alleging that despite paying charges towards booking the said holiday package, the company failed to provide the booking facility.

Asked for full amount

“The complainant was shocked when he was informed that they [the company] would not provide any booking facility until the complainant paid the full amount of over ₹1 lakh,” the consumer forum observed while noting the allegations made in the complaint.

Further, the travel agency was directed to pay an additional amount of ₹10,000 as compensation to the complainant towards litigation expenses.
