The Karnataka High Court on Wednesday directed the Intelligence Bureau (IB) to file a report in a sealed cover on the manner in which the Ansarul Islam Mahallu Committee, Palakkad, Kerala, had issued marriage certificate on March 30, 2016, certifying the marriage between one Muhammed Shihab Thacharam Kunnath, son of Muhammed Thacharam Kunnath and Sameera, daughter of Abdul Rahman.
The IB has to also inform the court on the steps it would take with regard to “such certificates being issued and produced for issuance of passports or any other documents which may legalise the entry of such persons into the territory of India, though such persons being foreign nationals had gained entry into the territory of India illegally and what steps are proposed to tackle such situations”.
Justice Aravind Kumar passed the order after perusing the contents, submitted to the court in a sealed cover personally by Labhuram, an IPS officer attached to the Foreigners Regional Registration Office, Bureau of Immigration, Ministry of Home Affairs. Mr. Labhuram, claiming privilege on the contents in the sealed cover, had requested that contents be looked into by the court alone.
‘Impact on national security’
“Perusal of the report/note would indicate appalling instances, which have a direct bearing and impact on the national security. Hence, the IB with any other agency as it deems fit shall coordinate with the said agencies and take immediate steps to ensure that such instances would not recur in future,” the court said in its order, without disclosing further on contents in the sealed cover.
Mr. Labhuram submitted the sealed cover during the hearing of an application filed by the Bureau of Immigration seeking more time, due to procedure to be followed, to deport a Pakistani couple, Kasiff Shamshuddin alias Kasiff, 30, and Kiran Gulam Ali, 30, natives of Karachi. The couple eloped from Pakistan and entered India without visas, and were nabbed in Bengaluru in 2017. They were found in possession of proofs for their local residence in Bengaluru secured using fake documents with the help of local agents. They were convicted by a trial court as they pleaded guilty. The High Court on April 26 directed the Union and State governments to deport them to Pakistan by May 5 as they had completed the sentence.
