5 get 7 years for assault

Mangaluru: The fourth additional district and sessions court on Thursday sentenced five people to seven years imprisonment, holding them guilty of launching a brutal assault on the owner of a popular readymade garments shop four years ago.
The case pertains to the attack on Kanhaiyya Lal Gupta, owner of Polo Sales, at the shop premises, which was reported on March 13, 2015.
Following a business dispute with Gupta, Irfan, 39, and Mohammed Mushtaq, 30, from Farangipete, Sameer K M, 27, from BC Road, Mohammed Irfan, 35, and Dilan Avinash Cardoza, 29, arrived at the Polo Sales premises and attacked Gupta with an iron rod. They also robbed Rs 28,500 from the cashier’s drawer before leaving the place.
Holding all five accused guilty of the crime, judge Mallanagouda sentenced them under IPC Sections 143 (unlawful assembly), 147 (rioting), 148 (rioting, armed with deadly weapon), 448 (house-trespass), 323 (voluntarily causing hurt), 324 (voluntarily causing hurt by dangerous weapons or means), 427 (mischief causing damage), 395 (dacoity) and 397 (robbery, or dacoity, with attempt to cause death or grievous hurt). In addition to the jail term, each of the five accised is directed to pay a fine of Rs 10,000.
Shantharam, then police inspector at Mangaluru North station, where a complaint was filed, submitted the chargesheet to the court. Public prosecutor Harish Udayavar represented the victim.
