HC: Remove illegal banquet hall from Gymkhana Club

Gurgaon: The Punjab and Haryana high court has directed the Haryana Shehri Vikas Pradhikaran (HSVP) to remove an illegal banquet hall erected on the grounds of Huda Gymkhana Club at Sector 29 within four weeks.
In September 2017, the HSVP (earlier known as HUDA) had leased out the land to Billu Tent House for construction of the banquet hall. The move had been challenged by the club members.

Justice Raj Mohan Singh, in his order dated April 8, directed Billu Tent House to remove all articles from the hall and handover the vacant ground to HSVP by May 9. Failing this, the HSVP would be entitled to confiscate the remaining articles, besides exercising the right to take lawful action against Billu Tent House, the court has said.

As per agreement, the HSVP was to pay Rs 45 lakh to the tent house in case the lease was terminated or cancelled. The agreement said Gymkhana Club has paid Rs 20 lakh to the tent house and adjusted Rs 25 lakh against dues.


Abhay Jain, convener, Manav Awaaj and a member of the Gymkhana Club. said: “Finally, after the intervention of the HC, the land that was illegally given to Billu Tent House has been restored to the Gymkhana Club.” When TOI contacted HSVP, officials said they will abide by the court order. Owner of Billu Tent House refused to comment.


The issue came to light in 2017 when Manav Awaaj and members of the club raised objections against leasing out land to the tent house. They alleged that the HSVP has caused the club a loss of Rs 110 crore by illegally giving the land to the tent house to set up the hall.


“In violation of rules, HSVP had given 11221 yards on lease at throwaway prices, without calling any tender or advertisement. The land was given on a nine-year lease for a paltry sum of Rs 35,00,000 a year against the official rent of Rs 12.58 crore a year, causing a loss of over Rs 110 crore to the club,” said Jain. The members had approached HSVP seeking termination of the lease. Billu Tent House had approached a lower court for a stay but it was rejected by the CJMs court in November.
