Frightening footage shows a learner driver's ute skid out of control before crashing into an embankment – but it's the reaction from police that has viewers' surprised

This is the frightening moment a learner driver swerved off the road and crashed into an embankment. 

Dashcam footage shows the ute driver lose control while changing lanes on the highway between Bathurst and Lithgow on Sunday.

The blue ute suddenly veered right and then left, before careering into the grass and coming to a stop.

The learner driver burst into tears and his father was left shaken - but neither were injured. 

Police attended the scene, but the officer decided not to fine the driver over the accident. 

The footage was uploaded to Facebook group Dashcam Owners Australia. 

A post by the person who filmed the incident read: 'At the end of the overtaking lane the L plater got too focused on the red car to his right and lost track of where he was in the lane and hit the dirt on the left and lost control. 

'The L plater driving and his father were both OK, however it scared the absolute living daylights out of the poor kid and he was literally in tears after the event from the shock.

'The father said his son has not done a lot of driving yet and this was his first experience on the highway. 

'HWP attended as by coincidence there was one that came the other way on the road just a few minutes after the accident.

'I showed the HWP officer the camera footage on the scene and the HWP officer did NOT issue a fine as he said, in his own words that the important thing was that they were both OK, and poor kid has learned a good lesson having the accident, and it would serve no purpose whatsoever to give him a $500 fine and take away his license for three months for a genuine accident that will be a good learning experience,' the person in the trailing car said.
