The Madras High Court has disposed of a petition filed by an advocate seeking a direction to Director General of Police (DGP) to register a first information report against Home Secretary Niranjan Mardi and Coimbatore Superintendent of Police R. Pandiarajan for having disclosed the name of a victim in the Pollachi sexual abuse case.
Justice G.K. Ilanthiraiyan disposed of the case after granting liberty to the petitioner A.P. Suryaprakasam to work out his remedy as enunciated in a judgment passed by a Division Bench of Justices M.M. Sundresh and N. Sathish Kumar on September 12, 2018, in G. Prabakaran versus Superintendent of Police.
In the judgment, the Bench had held that all those whose complaints were not entertained by the police could approach the jurisdictional magistrate under Section 156(3) of the Code of Criminal Procedure and lodge a private complaint. On receipt of such complaint, the magistrate could order an investigation into the issue.
