HC to decide on validity of JMM MLA vote in RS polls
TNN | Mar 14, 2019, 05:21 ISTRanchi: The Jharkhand high court on Wednesday framed the issues of argument in an election petition filed by Pradeep Kumar Sonthalia challenging the election of Congress candidate Dheeraj Sahu to the Rajya Sabha in the biennial elections in March 2018.
Sonthalia who lost the Rajya Sabha polls by 0.33 votes had filed a petition with the HC challenging the validity of vote cast by JMM MLA Amit Mahto, who was convicted on the day he voted. Mahto had cast his vote in the Rajya Sabha polls around 9:30am. Later in the day, about 2:30pm he was convicted in a case of assaulting a government official.
“The court of Justice A B Singh heard both the parties and decided that argument would take place on whether Mahto’s vote will be considered valid when he was convicted on the same day and was disqualified as an MLA. The court will start hearing arguments from April 25,” Rajiv Kumar, the lawyer appearing on behalf of the respondent said.
