Pune police book biker under culpable homicide charge

PUNE: The Deccan Gymkhana police on Wednesday invoked Section 304 of Indian Penal Code against the motorcyclist riding on the wrong side of the FC Road in the wee hours of Tuesday before colliding against a safety railing, resulting in the death of the pillion rider — a 23-year-old woman student.
If convicted under the stringent Section 304 (culpable homicide not amounting to murder) of the IPC, the punishment is up to 10 years in jail. The police on Tuesday had booked the motorcyclist, Hrushikesh Babar (25) of Raviwar Peth, for a relatively lesser offence under Section 304A (causing death by negligence) of the IPC, punishable up to two years.
Senior inspector Deepak Lagad said, “Babar knew that he was driving on the wrong side of a one-way stretch. Yet, he put his life and that of his woman colleague in danger. As he drove the motorcycle in the wrong direction despite being aware about the traffic rules, it cannot be negligence. Keeping this in mind, we invoked Section 304 of the IPC against him.”
The accident victim — woman student Samruddhi Gursale — resided as a paying guest in Kothrud. Babar suffered serious injuries and is under treatment in a private hospital on FC Road.
Gursale, Babar, and their two friends had dinner in a restaurant in front of Fergusson College around midnight. After a long chat, Babar and Gursale left around 2.40am and headed towards the Good Luck Chowk.
Babar, not wearing a helmet, rode the motorcycle along the FC Road in the wrong direction. The CCTV footage showed that he was riding the bike at a high speed. It collided against the safety barricades put to prevent accident around a dug-up area for the footpath widening and beautification work.
The accident spot has been dug up to facilitate the construction of footpath and other beautification works under the urban street development project, the police said.
The CCTV footage showed that Babar got up after the collision. But the woman remained motionless on the spot for a few minutes after falling on the road.
A few cars passed by the site without stopping. Babar and Gursale’s friends, who accompanied them, took them to the hospital.

Police identified the deceased as Laxman Ramakant Yadav (45) of Shivane and the injured pillion rider as Kailas Baloor Nishad (38). Senior inspector Devidas Gheware of the Dattawadi police said the deceased could have survived if he had put on a helmet.
