The Bombay High Court on Tuesday observed that the affidavit filed by the Commissioner of Police (CP) is not satisfactory and directed another affidavit to be filed on what steps will be taken to curb noise pollution in future.
A Division Bench headed by Justices Abhay Oka was hearing a bunch of petitions highlighting the violation of Noise Pollution (Regulations and Control) Rules, 2000, during Ganesh Chaturthi, Navratri, Eid-e-Milad and other festivals.
On February 20, the Bench had directed the CP to file an affidavit on why action was not taken against those who violated the norms and what action will be taken against erring police officers.
Punishment not stated
The court went through the affidavit and said that it was not as per the last order. It said there was no mention of what punishment will be meted out to the erring officers.
“We don’t want any particular officer to be targeted but this affidavit does not talk about steps to be taken in future in order to control noise pollution,” the judges said.
The court has directed the CP to file a fresh affidavit before March 20.
