Court rejects bail plea of rape accused

The 6th Additional District and Sessions Judge D.T. Puttarangaswamy has rejected bail application of Mohammed Nizamuddin K., 26, of Uppinangady, who is an accused in a rape case.

According to the complaint registered with the Women’s Police Station, the victim girl got acquainted with him when she admitted her father to a private hospital in Deralakatte. She was getting medicines for her father from a shop in Mangaluru. Under the guise of obtaining the medicines for her, Nizamuddin called her to Hampankatta on June 18, 2018. He took her to a hotel in Hampankatta, reportedly asked her to consume a fruit juice laced with a sedative and raped her.

Blackmail

Nizamuddin also allegedly took photographs of her on his phone and used the same to blackmail and sexually assault her in the next few days. When she changed her mobile number, Nizamuddin reportedly called her mother and hurdled abuses. The victim ultimately told her uncle about the incident and then filed a complaint.

The Women Police arrested Nizamuddin for offences under Sections 376, 504 and 420 of the Indian Penal Code. He was lodged in Mangaluru District Prison since February 5, 2019.

Claiming innocence of the alleged offence, Nizamuddin approached the court seeking bail under Section 439 of the Criminal Procedure Code.

Opposing the bail application, the prosecutor said if Nizamuddin was released on bail there were chances of him absconding from the case and further troubling the victim.

Rejecting the bail application, Judge D.T. Puttarangaswamy, in his order dated March 6, said, “Here allegation against the petitioner shows a heinous nature. Now, the case is under investigation. At this stage, it is not satisfied to grant bail to the petitioner.”
