Apple executive Vivek Tiwari's killing: Both cops to be tried on murder charges

LUCKNOW: In the sensational murder case of Apple executive Vivek Tiwari, additional sessions judge S S Pandey has found prima facie evidence of abetment to kill against accused policeman Sandeep Kumar.
The court on Thursday said that from the material on record collected during investigation, a prima- facie case under Section 302 read with Section 114 of IPC was being made out against Sandeep.


Since Sandeep is on bail for offence under Section 323 IPC only, the court directed him to surrender before it on March 22 for charges of graver offence sunder Section 302 and 114 of IPC. The court will hear the matter on next date on the question of framing of charges against accused Prashant as well as Sandeep.


The prosecution and Vivek's widow had sought framing of charges against Sandeep under Section 302 IPC along with Prashant alleging there was ample evidence against him.


It may be recalled that the police had filed CS against Sandeep under Section 323 IPC only, but the widow of Vivek had been insisting on framing charges against him under Section 302 IPC too.


Vivek was shot dead on September 29, 2018 in Gomtinagar. His widow Kalpana had lodged an FIR with Lucknow police in the matter.
