Charges against Shahrukh Khan to continue: Rajasthan HC

JAIPUR: The Rajasthan High Court on Wednesday ruled that the court will continue to press charges against Bollywood actor Shahrukh Khan, of rioting and endangering life and personal safety of others during the promotion of his film ‘Raees’ in 2017 at Kota railway station, against the wishes of the petitioner.

The single bench of justice K S Ahluwalia was hearing a petition by Shahrukh Khan to quash the FIR.

The Government Railway Police (GRP) in Kota, lodged an FIR against the actor on a complaint by Vikram Singh, a railway vendor, under various sections of IPC including rioting, while he was in Kota railway station for the promotion of his film ‘Raees’ on January 24, 2017.

Khan was aboard August Kranti Rajdhani Express, on way to New Delhi from Mumbai, which had briefly halted at Kota station around 5am.

The case against Khan has been lodged under Indian Penal Code sections 147 (rioting), 149 (unlawful assembly), 160 (affray), 427 (mischief causing damage to the amount of fifty rupees or upwards), 120B (criminal conspiracy); section 3 (mischief causing damage to public property) of the Prevention of Damage to Public Property Act, 1984; and sections 145 (drunkenness or nuisance) and 146 (obstructing railway servant in his duties) of the The Railways Act, 1989.

Singh alleged that the actor did not get down from the train. He waved to his fans and started throwing gifts at them. One such gift was hurled near Singh’s trolley.

The trolley was damaged as people rushed to catch the gift. Singh added that the food on his trolley was scattered and a stampede-like situation was created.

Amid all this chaos, money from his coffer was stolen and he had also suffered injuries. The incident also resulted in destruction of public property.


However, on Wednesday, Vikram Singh, who was present in the court, said he was not interested to pursue the case any longer.


The judge then asked him if he had filed it only for publicity stunt. Public prosecutor Sher Singh Mahla, objecting to the petitioner, said the petitioner could not decide the case as the matter involves loss of public property.


He said the railway police in its report prima facie found the actor guilty of rioting and endangering life and personal safety of others. The matter was posted for next hearing on May 28.
