Harassed by lawyer, judge complains, refuses to hear case

MUMBAI: In an unusual scenario, a judge in the Thane sessions court took strong exception to heated arguments and bullying by a defence lawyer on Thursday and said he will complain to a senior judge and wanted the cases taken to another court.
Additional sessions judge V Y Jadhav adjourned hearing in two cases - murder of Navi Mumbai builder Sunil Lahoria and an attempt on the life of his son Sandeep - and said in open court he would not hear the cases anymore and would complain to the principal judge.
The problem started on Wednesday, when lawyer Baba Shaikh began arguments for his clients - accused builder Suresh Bijlani, former cop Emmanuel Amolik and architect Anurag Garg - and demanded that the court deliver its ruling on Sandeep's case immediately.
"The matter worsened on Thursday, when Shaikh demanded that he get to examine his witnesses on a priority basis. The judge refused, and this triggered a heated argument," said an advocate. During the half-hour argument, Shaikh apparently threatened the judge, saying he will complain to his seniors. Infuriated, Jadhav brought the entire matter on the record of the court, and refused to hear the cases.
Lahoria was shot outside his office in Vashi on February 16, 2013, allegedly at the behest of the accused as Lahoria had tried to expose the illegal constructions of his rival. Later, an attempt was made on his son Sandeep's life.
Incidentally, special public prosecutor Vilas Naik, appointed in place of Vidya Kasle, was not present in court. "We fear the accused will take advantage of this incident and may apply for bail," said a lawyer representing Sandeep.
