Nirbhaya convicts to file curative petition

NEW DELHI: A Delhi court on Saturday was informed that the three convicts convicted in the 2012 Nirbhaya gang rape and murder case might soon file a curative petition challenging the death penalty.
Additional sessions judge Anu Grover Baliga was hearing a plea filed by Nirbhaya’s mother seeking death warrant of four convicts without any delay.
Advocate A P Singh, counsel for the convicts Pawan Gupta, Vinay Sharma and Akshay Kumar Singh, said they might soon file a curative petition challenging the 2018 SC order dismissing their review petitions on July 9, 2018.
An SC bench comprising Chief Justice Dipak Misra and Justices R Banumathi, Ashok Bhushan rejected had the pleas of the three of the four convicts Mukesh (29), Pawan Gupta (22) and Vinay Sharma (23). The prisoners are now left with an option to file a curative plea in SC and a mercy plea before the President to prevent death.
Meanwhile, judge Baliga, directed the jail authorities to file a status report by April 6.
Through her lawyers, Jitendra Kumar Jha and Seema Kushwaha, Nirbhaya’s mother said the death penalty awarded to the convicts was confirmed by Delhi HC and the SC. “Need of the hour is that the sentence must be executed as early as possible. Not only the entire nation is awaiting the execution of the sentence, but the world is curiously looking at the Indian judicial system,” the plea said.
