SUV gang rape case: SC notice over father’s plea in Ahmedabad

AHMEDABAD: The Supreme Court has issued notice to the state government over an appeal filed by the father of complainant woman in the SUV gang rape case complaining about the alleged bias of city police in the investigation.
The apex court has sought the government’s reply within two weeks’ time after issuing notice on February 25. Complainant’s father moved the SC after Gujarat high court disposed his petition on December 10 last year after the city police filed a report in metropolitan court in November proposing closure in the case on the ground that the woman had filed false rape complaint against the accused persons to wreak vengeance on them.
In June last year, the 22-year-old complainant alleged gangrape in a moving SUV. The investigators did not arrest accused persons, the complainant’s friends – Vrushabh Maru, Gaurav Dalmiya and Yamini Nair, and went ahead with the probe. The cops did not seek custodial interrogation of the accused, but sought their narco analysis.
At this juncture, the complainant’s father had moved the HC demanding that the accused persons should not be permitted to prove their innocence through narco analysis. He took exception to police’s gesture of seeking truth serum test of the three accused and argued that the cops should have first arrested and interrogated them if they were not cooperating with investigation. He had also demanded that the accused be arrested.
While disposing the petition, the high court had asked the petitioner to raise the objections against the alleged inaction on part of police before the metropolitan magistrate, who is to decide on the B summary filed by police. Cops have claims that the complainant filed a false complaint against Vrushabh Maru, Gaurav Dalmiya and Yamini Nair and she herself concocted evidence to frame the trio.
