A father has pleaded guilty to drink driving after being caught riding a motorised scooter more than three times the legal limit. 

Anthony Lee Preston, from Queensland, returned a blood alcohol reading (BAL) of .174 when police pulled him over after he ran a red light in Brisbane's Fortitude Valley in January, 9 News reported. 

After he pleaded guilty to the charge Preston was issued with a $400 fine and some stern words from the magistrate who called him 'stupid' for 'drink-riding' a scooter. 

Preston was remorseful after he was approached by reporters on leaving court but said he had 'no idea' what he was doing was illegal.

'I had no idea, thought I was doing the right thing,' he told reporters. 

'At the time I just wanted to get home.' 

The video shows police stop Preston after he runs a red light and the ask him politely to wheel it off to the sidewalk. 

The officer then explains to Preston that he has broken the law not just by running a red light.

Under the Transport Operations (Road Use Management) Act 1995 it is illegal to operate vehicles, not just cars and trucks, while over the blood alcohol limit. 

'Any person who, while under the influence of liquor or a drug, drives or is in charge of any vehicle (other than a motor vehicle) on a road, or attempts to put in motion any vehicle (other than a motor vehicle) on a road, is guilty of an offence,' it states. 

The offence carries a maximum penalty of a $4,400 fine or nine months in jail.
