An IGA worker pinched the bottom of his female co-worker during a promotional Christmas photo-shoot for ham said he did it because it was 'in the Christmas spirit.'   

The female co-worker, 61, who worked with Brent Stowell Marshall, 56, at Wonthella Supa IGA in Western Australia, retaliated by punching him in the stomach. 

Marshall, a meat section worker, pleaded guilty to pinching the woman's bottom but was given a spent conviction after his lawyer told the magistrate that 'he was close to retiring anyway.'

Marshall's lawyer, Kate Fry, stated that her client was friends with the victim and only pinched her on the bottom because it was 'in a sort of Christmas spirit.'  

Ms Fry suggested that Marshall should avoid a conviction because 'he's very close to retirement and is unlikely to commit such an offence again,' The West Australian reported.

'He is very remorseful. He intended no malice whatsoever,' Ms Fry told the magistrate. 

Magistrate Chris Miocevich gave Marshall a spent conviction because Marshall had no previous criminal record.

Marshall is required to pay $205 in costs and be put on an eight-month $400 conditional release order. 

Marshall is rumoured to still be working at Wonthella Supa IGA in the meat section while the woman he assaulted has transferred to another store.
