Mumbai: Woman arrested for abetting kid's sex abuse by 'paramour'

MUMBAI: A 30-year-old mother of two has been booked and arrested under stringent provisions of the Protection of Children from Sexual Offences (POCSO) Act for allegedly abetting the sexual assault of her 12-year-old daughter by her alleged paramour. The woman's bail plea was rejected by a special court this week. The child had told police that her father had a mental illness. She stated that taking advantage of this, her mother had an affair with that man.
The child said her mother used to give her father sleeping pills, after which the accused used to visit their home and stay over. She alleged that during his visits, the accused used to touch her inappropriately and show porn videos to her and her brother. The child said that she brought this to her mother's notice, but she did not pay heed.
She complained to her grandmother and another relative, after which a police complaint was filed.
The mother and her paramour were arrested on January 10. Seeking bail, the mother told court that she had been falsely implicated. She also claimed she was arrested for not informing police about the abuse. The mother claimed that there was no specific allegation of sexual assault against her.
She claimed she did not have any criminal antecedents and was never involved in any offence. The mother said she was the sole earning member of the family and needed to be released on bail.
The prosecution opposed the bail plea and said the statements of both children, supporting the prosecution's case, were recorded before the magistrate. The prosecution submitted that the accused, being the victim's mother, would threaten witnesses if granted bail.
Refuting the submissions made by the mother, the court said, "It is submitted on behalf of accused that she is arrested only on the grounds that she failed to file a complaint. But she is equally responsible for the act done by co-accused (paramour). If released on bail, there is every possibility of tampering with prosecution evidence and witnesses."
