Bhopal: In a major setback to the Nath government, the Madhya Pradesh High Court on Thursday rejected the show cause notice issued by the government to Chhindwara mayor Kanta Yogesh Sadarang for financial irregularities. The notice was served on January 31. High Court judge Justice Atul Shreedharan passed the above order.
The state government had issued the show cause notice to Sadarang in connection with financial irregularities and to remove her from the post. The notice served by the Urban Development and Housing Department mentioned that action would be taken against the guilty if it failed to get reply within 15 days after the receipt of the notice.
A three-member team has been constituted to probe financial management, compliance of new accounts rule, correct use of amount of the Union and State Government and to examine correct implementation of legal procedure of council and mayor council besides provisions of the Madhya Pradesh Municipal Corporation Act -1956. Former Advocate General Purushendra Kaurav, who appeared on behalf of Chhindwra mayor said, “High Court has rejected the show cause notice stating that it is premeditated and not reasonable. Actually, the state government selectively constituted team to enquire into the functioning of three municipal bodies— Gwalior, Chhindwara and Rewa.
The court said that the state government has already constituted a 3-member committee so it shows that the state government has already formed opinion against the Chhindwara mayor. However, liberty has been granted to proceed a fresh as per the law.”
Advocate General Rajendra Tiwari said that the petition is not maintainable as mayor has not given reply to the show cause notice.” High Court rejected the show cause notice stating that it is premeditated and not reasonable.
