Man moves court to be with wife, sees new hubby

AHMEDABAD: A man had the shock of his life when he moved the high court to reunite with his wife claiming that she had been forcibly taken away from him by her parents and confined against her will.
The woman appeared in court last week and placed a divorce deed. As if it was not enough, she also informed the court that she had remarried in the meanwhile and has started a new life with her second husband. This development took place within a month’s time.
The man and woman are from Palanpur town in Banaskantha district. They had eloped two years ago, got married, and were living in Abu town as man and wife when the woman’s family members traced them and brought them to Palanpur and separated them. This happened in December last year.
Since he was not allowed to meet his wife, the man approached the high court and filed a habeas corpus petition on December 27. He claimed that his legally wedded wife was being forcibly detained by her family members. The court should order her presence and ensure her will.
On February 6, the woman came to the court with her family members and new husband. She told the court that she was already divorced from the petitioner.
She submitted a divorce deed in the court. She also supplied a marriage certificate dated January 31 proving her marriage to another person. She said she had married the man to whom she had been betrothed in her childhood according to the customs of the Chaudhary community in north Gujarat, said advocates involved in the litigation.
The woman also made it clear that she did not want to go with her first husband, but intended to start a new life with her second husband. The court recorded her statement and said, “She cannot be asked to go and stay with the present petitioner (first husband).” The court dismissed the habeas corpus petition.
