Harris Personal Injury Lawyers filed a complaint December 21, 2018 in the Monterey County Superior Court against the California Department of Transportation; the California Highway Patrol; and the responsible drivers (among other responsible parties). Harris Personal Injury Lawyers filed an amended complaint on January 22, 2019. The complaint was filed under case number: 18CV004851.

Per the amended complaint, on April 24, 2018, Vijay Bhakar and two family members were traveling on Southbound U.S. 101, .4 miles south of Salinas, California, when they encountered abruptly stopped traffic due to a lane closure. The suit alleges that California Department of Transportation closed the lane for a re-striping project. The Plaintiffs’ vehicle was then rear-ended. Per the complaint, Vijay Bhakar was killed, and the other two occupants of the vehicle—Ajay Bhakar and Adersh Singh Landa—suffered serious injuries.

The suit alleges that California Department of Transportation and California Highway Patrol created a dangerous condition on the roadway at the time of the collision by causing Lane Two to abruptly close, which reduced the roadway to only one lane; causing the re-striping project to occur during a busy, unsafe time and place; allowing the roadway to lack adequate signs, barriers, and warnings; and by their negligent control of traffic. Per the complaint, this created a hazardous trap for approaching motorists in that the dangerous condition was abrupt and was not readily recognizable to the average driver. The suit alleges that this dangerous condition tragically caused the premature death of Vijay Bhakar and the serious injuries of the other family members in plaintiffs’ vehicle.

The suit also alleges that the driver defendants breached a duty of care owed to the plaintiffs by driving in a careless, inattentive, or negligent manner. Per the complaint, this breach of duty caused the accident that killed Vijay Bhakar and seriously injured other occupants of the plaintiffs' vehicle.
