FIR closure scam: 7,324 cops face disciplinary action in Tamil Nadu

CHENNAI: The Tamil Nadu police have initiated departmental proceedings against at least 7,324 police officers for failing to complete probe in cases and allowing ‘closure’ of 2.14 lakh FIRs between 2008 and 2014.

The Madras high court was informed about it on Tuesday by the state director-general of police in response to a query from Justice MV Muralidharan who had stumbled upon the FIR closure-spree by magistrate courts on the pretext of non-filing of chargesheets within the statutory period ranging from 45 to 180 days.

“In compliance of the directions passed by the court, a memorandum has been issued to all commissioners and district superintendents of police to fix responsibility and take action against the erring officials,” the DGP said in an affidavit.

This apart, all district heads have been directed to follow the guidelines to streamline investigation and file final reports on time to avoid closure of FIRs under Section 468 of CrPC, he added.

The DGP further pointed out that no separate registry was maintained in magistrate courts regarding filing of chargesheets resulting in such anomaly, he wanted the court to direct the magistrate court to maintain such registry.

The issue pertains to closure of 2,14,901 FIRs by magistrate courts across Tamil Nadu for non-filing of chargesheets by police within the statutory time limit between 2008 and 2014.


The issue came to light while hearing an appeal moved by Safire Print Lab Knits and Woven Fabric, a Tirupur-based company against the commissioner of employees’ compensation granting Rs 3.94 lakh damages to an employee of the firm who died in an accident while at work.


Taking serious view of the issue, Justice Muralidaran on December 18, 2018 directed the court registry to call for particulars of such closure orders passed by magistrates across the state.


The court further condemned the conduct of the magistrate and police concerned and ordered the public prosecutor A Natarajan and additional advocate general P H Arvindh Pandian to personally inquire all the 87 cases by calling for an explanation from the police concerned.
