McDonald's punch-up attacker walks free from court after dodging jail - despite leaving his victim with a brain bleed and dislodged teeth

A one punch attack at a McDonald's restaurant left a man with a brain bleed and dislodged teeth – but his attacker has walked free from court.

Troy James Badger pleaded guilty to the assault in Cairns District Court on Wednesday and walked away with a wholly suspended sentence.

The court heard that on July 15, 2017, Badger ran up to the 44-year-old victim as he was talking to a group at the entrance to a Brisbane McDonald's and kicked him in the leg before punching him in the face, according to The Cairns Post.

The 27-year-old plead guilty to causing grievous bodily harm, although his defence barrister Josh Trevino argued it was a 'brain snap' under the influence of alcohol.

'There were a lot of stressors in his life at the time of the incident,' he told the court.

He also said his client had enrolled in anger management courses.

Prosecutor Tom Hancock said that the victim had spent over $5300 dollars on dental work and still needs another $1500 worth of treatment.

Badger was ordered to pay $3000 compensation after initially offering $5000 that he had saved from working in Cairns.

Mr Hancock also pushed for a strong sentence, labelling the attack 'gratuitous unprovoked street violence.'

Judge Dean Morzone QC gave Badger a wholly suspended 20-month jail term after taking into account the defence's argument he was the sole provider for his wife and young child.
