Bhopal: Supreme Court, on Monday, stayed the Madhya Pradesh government order of recovering of 12 per cent per annum for the adjustment of the arrears of 6th Pay Commission from doctors, medical officers, dental surgeons, specialists and dental specialists.
Special leave Petition (SLP) was filed for motion hearing by MP Medical Officers Association (MPMOA) on Monday before the apex court. The court admitted the SPL and clubbed it with petition of others medical officers and ordered stay in the matter.
Terming it as a big relief for the medical fraternity, Dr Devendra Goswami, president MPMOA said that the government was adamant for recovery along with adjustment of arrears of the 6th pay commission. Medical officers were aggrieved by the order dated on May 30, 2012 passed by respondent State Government of Madhya Pradesh and the consequential orders dated June 1,
2012 and July 23, 2013 whereby the recovery along with the interest at 12 per cent per annum have been ordered and also directed for the adjustment of the arrears of 6th Pay Commission from the proposed recovery. Madhya Pradesh government had sanctioned four staged benefits as per 6th pay commission in May 25, 2009.
He informed MPMOA had challenged the order in High Court whose single bench had quashed the order and directed the government to continue to extend the benefit of respective grade scale. However, the Government then moved to double bench which passed the order against medical officers.
Disappointed by double bench order of High Court, MPMOA and other doctors in personal capacity approached Supreme Court, he added. “The Supreme Court after admitting our petition has now stayed the government order and this has come as a huge relief to us, said a relieved Goswami.
