A Delhi court has granted bail to a man charged with tearing pages of the Constitution and setting it on fire and passing remarks against the dalit and tribal communities during a demonstration against the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act last August.
Allowing bail application of accused Krishan Mohan Rai, filed through Mrinal Madhav, Additional Sessions Judge Satish Kumar Arora said: “Admittedly, chargesheet qua one of the accused has already been filed and he is on bail. Cognisance is yet to be taken for want of necessary sanction.”
“Some of the other accused were subsequently apprehended and are on bail. Investigation qua these accused and the accused/applicant is going to take time and no useful purpose would be served by keeping the accused/applicant in custody,” the judge further said.
“Considering the given facts and circumstances, the plea of bail of accused/applicant is allowed and he is admitted to bail on his furnishing bail bond in the sum of ₹20,000 with one surety in the like amount...,” the court said.
The Parliament Street police have booked him under Sections 153A (promoting enmity between classes) and 504 (insult intended to provoke breach of peace) of the Indian Penal Code, the Prevention of Insults to National Honour Act and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
