Conviction after decade: Man gets life term for murder

Kanpur: Additional district and sessions judge (Xth) of Kanpur Nagar, Ashok Kumar Yadav, on Thursday convicted one Virendra for committing murder and sentenced him for life imprisonment along with a fine of Rs 20,000.
According to additional district government counsel (AGGC) Kailash Shukla, Virendra had ‘shot dead’ one Shivaji Agnihotri on November 28, 2008.

Presenting his case before the court, the ADGC submitted that Shivaji, a resident of Sharda Nagar along with his two friends Saurabh and Arvind was going to a market around 9 pm on that day when two motorcycle-borne youths coming from behind pressed horn of their motorcycle for a passage. While Arvind and Saurabh gave passage to the motorcycle, one of the riders started abusing Shivaji.

Shivaji opposed and soon heated arguments took place. One of the motorcycle-borne youth then pulled out a country-made pistol and fired at Shivaji, who fell on the ground after being hit. The motorcycle-borne youths sped away on their vehicle, the ADGC submitted.

Shivaji later succumbed to his injuries in hospital. Kalyanpur police registered a case of murder against unidentified man, but could not trace the killer, the ADGC stated.

He further apprised the court that after around seven months of the incident, Saurabh visited Kanpur court for some personal work where he spotted an undertrial being fetched from lock-up to be produced in a court. He immediately identified him as ‘killer’ of Shivaji and informed Krishnakant, father of Shivaji, and Kalyanpur police.


The police inquired the matter and established the identity of that undertrial as Virendra alias Nanha alias Trailer, a resident of Boodhanpur village in Choubeypur police circle. The police also recovered the pistol used in the murder during investigation.


Shukla further said that he had produced 13 witnesses, including Saurabh and Arvind. Later, Arvind turned hostile during cross-examination at the time of his evidence. Saurabh identified Virendra in open court.


The presiding judge, after going through the evidence on record, sentenced Virendra with life imprisonment. The court also punished him with a fine under Arms Act.
