The Delhi High Court has declined compensation to the family of a young motorcyclist, who died in a truck accident, as he did not have a valid driving licence.
The court said that in the absence of a valid permit, victim Ziyakhan (21) should not have driven the motorcycle on the road, which automatically inferred a “definite threat” to the public. Justice I.S. Mehta said that the truck driver merely being a party to the accident per se is not liable, even when the claimants have not discharged their onus. The court dismissed the appeal of Ziyakhan’s family, who died in the road accident in August 2012, against the order of a trial court denying them the claim.
