Now, DK moves Madras HC against 10% quota for forward castes

CHENNAI: A week after the DMK moved the Madras high court questioning the legality of 10% reservation for forward community candidates in education and employment, Dravidar Kazhagam (DK) followed suit and filed a similar PIL in the court.

“The concept of equality as enumerated in the preamble of the Constitution is being thoroughly misused under the guise of upliftment of the economically weaker section by the amendment,” advocate D Veerasekaran said while moving the plea on behalf of DK. Admitting the plea, a division bench of Justice S Manikumar and Justice Subramonium Prasad tagged the petition along with DMK’s plea and posted it to February 18 for further hearing.

According to the party, the amendment was brought in a hurried manner without any discussion and was made with politically motivated agenda with the 2019 general elections in mind.


The petitioner, referring to various amendments made to the Constitution, contended that social, economic and political justice as mentioned in the preamble of the Constitution must be considered all inclusively and that of economic justice alone could not be parted away from the three.


Economic criteria alone cannot be considered as a separate class, hence the impugned amendment, including the economically weaker section of the forward caste in the scope of reservation is against the basic structure of the Constitution, the petitioner said.


“Though DMK MP Kanimozhi pleaded for placing the Bill to selection committee for study of the pros and cons, the same was not accepted and the Bill was passed, and the assent of the President was given on January 12 and gazette publication was made on January 14,” the petitioner said.
