Tilak Nagar fire: Builder's bail plea rejected

MUMBAI: The sessions court on Thursday rejected the anticipatory bail plea of builder Subhak Mahapara who has been booked for the Tilak Nagar fire that claimed five lives last month.
After the petition was rejected, Subhak’s partner Hemendra Mahapara, who too had moved an application for anticipatory bail, withdrew his application. The two are partners at Reliance Realtors, which constructed the building in Sargam Society, where the fire broke out on December 28.
Subhak, in his application, said he was 65 years old, willing to cooperate with the cops and ready to give Rs 2 lakh compensation as well as a flat to each affected family. However, the police said that the crime was very serious as five people had lost lives. Cops said the builders illegally gave possessions without obtaining occupation certificates and no-objection certificate from the fire brigade. They have also claimed that the builders manipulated building plans.
“They obtained permissions for something and there is something else in reality. On paper, the 15th floor is supposed to have refuge area. But the 15th floor refuge area is a terrace sold to one Karan Kuril for Rs 18 lakh,” said the police in their affidavit.
“The builder also sold open parkings and blocked the main entrance, which prevented the fire brigade engines and water tankers from entering the compound,” said an officer.
The police said the fire-fighting system has been installed but is not up to the mark. Also, the electric board is installed near the stairs. Cops said they need to collect documentary evidences and want custodial interrogations of the accused to extract the documents submitted to various government agencies. Reliance Realtors’ third partner, Kothari, too has been booked.
